A clear written rent agreement prevents most landlord–tenant disputes. Here is what to know before you sign.
Why 11 months?
Under the Registration Act, 1908, a lease for more than one year must be registered. Many people choose 11-month agreements to avoid compulsory registration and its costs. Shorter agreements still need proper stamp duty, which varies by state.
Clauses to include
- Names and addresses of landlord and tenant, and the property address
- Rent amount, due date and mode of payment
- Security deposit and the conditions for refund
- Duration, renewal and annual rent increase
- Notice period for either party to end the agreement
- Who pays maintenance, electricity and water charges
- Rules on subletting, repairs and permitted use
Stamp duty and signing
Print the agreement on stamp paper of the value required in your state, or use the state's e-stamping facility. Both parties and two witnesses should sign. Keep copies of ID proof and the signed agreement.
Registered agreements
Agreements longer than 11 months should be registered at the sub-registrar office. Several states also offer online or leave-and-licence registration, which makes the agreement much stronger as evidence.
